Legal Landscape

  • Psilocybin remains a Schedule I controlled substance under United States federal law. This means that, outside of specific legal exemptions, its use, possession, and distribution are prohibited.
  • Some jurisdictions have decriminalized or legalized aspects of use; these do not override federal law.
  • Some religious organizations may seek protection under the Religious Freedom Restoration Act (RFRA). However, legal exemption is not automatic—churches must apply for and receive a specific exemption from the DEA. Most exemptions are currently pending or denied, and operating without one carries significant legal risk.
  • Certain states and cities have decriminalized or legalized psilocybin for medical or spiritual use, but these changes do not override federal law. We monitor legal developments closely and update our policies as needed.
